An Italian tribunal has determined that Netflix unlawfully increased subscription fees for customers in Italy across a seven-year timeframe, mandating the streaming service to compensate millions of affected users.
The decision came from Rome’s Court of First Instance, Sixteenth Civil Division, on April 3rd, declaring that Netflix’s pricing adjustment provisions were “oppressive and void.” The legal challenge was initiated by Movimento Consumatori, an Italian advocacy organization for consumer rights.
Judges determined that Netflix violated Italy’s Consumer Code by implementing subscription price modifications without providing legitimate justification within contractual agreements. Such disclosure represents a fundamental obligation under Italian consumer protection legislation.
Regarding the Premium subscription tier, illegal rate adjustments occurring in 2017, 2019, 2021, and 2024 accumulated to €8 monthly. The Standard subscription tier saw cumulative increases totaling €4 per month.
A Premium plan holder maintaining continuous service since 2017 stands to recover approximately €500. Standard tier subscribers could claim roughly €250 in restitution.
Data from Italy’s telecommunications regulatory body indicates Netflix attracted over 8 million individual users throughout Italy in 2024. Active paying subscribers numbered 5.4 million as of 2025.
Court-Mandated Actions

Netflix has a 90-day deadline for implementation. Non-compliance triggers financial penalties of €700 for each day of delay.
